Business Immigration & Hiring Foreign Workers

Before hiring a foreign worker, employers may be required to obtain a positive Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC), confirming that the position cannot be filled by a Canadian citizen or permanent resident. While certain categories are LMIA-exempt, a valid work permit may still be required depending on the nature of the work and activities performed.

Employers outside Quebec may hire home care workers without an LMIA through the Home Child Care Provider and Home Support Worker pilot programs. In some circumstances, home care workers may also be hired after obtaining an LMIA under the Temporary Foreign Worker Program.

Certain roles — including business visitors, clergy, health care students, and performing artists — may not require a work permit; however, conditions apply depending on the activities undertaken in Canada.

ESDC assesses LMIA applications based on multiple factors, including job creation or retention for Canadians, labour shortages, prevailing wage requirements, acceptable working conditions, and the potential impact on labour disputes. Following a positive LMIA, the foreign worker must apply for a work permit. Work permits are typically issued for one to two years, subject to program criteria.

Work or Business Travel under CUSMA / USMCA (Previously NAFTA)

Canadian business visitors may enter the United States on a temporary basis when engaging in international business activities related to research and design, growth, manufacturing and production, marketing, distribution, after-sales service (including warranty or service contracts), and other general services such as financial services, public relations, tourism, and translation services.

Under CUSMA/USMCA, qualifying professionals may work across borders provided the primary source of remuneration remains outside the host country and the principal place of business is maintained in the home country.
