01 Do I legally need a lawyer to buy or sell a house in Ontario?

A real estate lawyer is involved in completing the legal transfer of title, reviewing the closing documents, handling funds, and registering the transaction on title. While the negotiation and preparation of the offer are commonly handled with the assistance of a real estate professional, the legal closing requires lawyer involvement.Mann Law represents buyers, sellers, and lenders on residential and commercial real estate transactions throughout Mississauga, Brampton, and the GTA.

02 How much is land transfer tax in Ontario, and does Toronto charge extra?

Ontario imposes Land Transfer Tax on property purchases, with the amount calculated using graduated rates based on the property's purchase price.Properties located within the City of Toronto may also be subject to a separate Municipal Land Transfer Tax.Eligible first-time homebuyers may qualify for available rebates.Because tax rates and rebate rules can change and eligibility depends on the specific transaction, Mann Law's real estate team can calculate the applicable amount based on the property and purchaser circumstances.

03 What's included in real estate closing costs beyond the purchase price?

Closing costs can include legal fees, Land Transfer Tax, title insurance, registration charges, searches, government fees, and adjustments for items such as prepaid property taxes, utilities, or other property-related expenses. The actual amount depends on the property, purchase price, financing arrangements, and circumstances of the transaction.Mann Law provides clients with a breakdown of anticipated legal fees, disbursements, and closing adjustments before completion so the financial requirements of the closing are clear.

04 What is the difference between a gross lease, a net lease, and a percentage lease?

Under a gross lease, the landlord generally assumes most property operating expenses as part of the rent structure.Under a net lease, the tenant may be responsible for some or all additional costs such as property taxes, insurance, maintenance, or operating expenses.A percentage lease, commonly seen in retail environments, can require the tenant to pay base rent plus an agreed percentage of sales.Because the lease structure directly affects the true cost of occupying a commercial property, Mann Law reviews and negotiates commercial leases before tenants or landlords commit to their terms.

05 Can a landlord evict a residential tenant in Ontario without going through the Landlord and Tenant Board?

A residential landlord generally cannot simply change the locks or physically remove a tenant because rent is unpaid or a tenancy has ended.Ontario's residential tenancy process requires landlords to follow the applicable notice, application, and enforcement procedures, including proceedings before the Landlord and Tenant Board (LTB) where required.Mann Law assists landlords and tenants with residential tenancy disputes, including eviction applications, rent matters, and maintenance-related claims.

06 What should I check before buying a commercial or industrial property?

Commercial and industrial real estate due diligence can involve significantly more than reviewing title.Purchasers may need to examine zoning and permitted uses, environmental conditions, surveys, easements, restrictive covenants, financing requirements, building issues, and any existing leases affecting the property.Mann Law assists with due diligence for residential, commercial, and industrial transactions, including specialized acquisitions involving franchised locations, hotels, and manufacturing properties.

07 How does mortgage refinancing work, and does it require a lawyer?

Refinancing generally involves replacing or restructuring an existing mortgage, often to obtain different financing terms, consolidate obligations, or access available equity.A lawyer handles the legal documentation, reviews the new mortgage instructions, arranges for the existing mortgage to be discharged where applicable, and registers the new financing on title.Mann Law prepares and reviews refinancing documentation for borrowers and lenders across Ontario.

08 What happens if a real estate deal falls through after the agreement is signed?

The legal consequences depend on the wording of the Agreement of Purchase and Sale, including any conditions, representations, warranties, deadlines, and termination provisions.Depending on the circumstances, questions may arise regarding the deposit, damages, termination rights, or whether the transaction can still be completed. This is why significant conditions and obligations should be reviewed before signing whenever possible.Mann Law reviews real estate agreements and disclosures and can also advise buyers or sellers where a transaction has already developed a dispute or closing problem.

Buying, Selling, Leasing, or Refinancing Property?

A real estate transaction can involve title, financing, tax, contractual, and closing issues that should be addressed before money and ownership change hands. Early legal review can help identify problems while there is still time to deal with them.
